The presentation will go over ways to present corroboration in Article X cases. This includes medical records and a discussion of Ortega/Benton and statements by non-patients, 911 tapes, experts, and prior acts.

Child Welfare Legislative Updates
(1.5 CLEs provided by NYPWA):

This session will present an analysis of new laws enacted in 2019, that impact child welfare, including Chapter Laws 434, 491, 182, 623, 125, 399, 732 and others. Some of the  topics include the foster care notice bill, the relative definition bill, the adoptee’s right to a birth certificate, and implementation of changes in PINS policy. We will also review bills vetoed that may be reintroduced in some form in the future.

Child Welfare Confidentiality and the Media
(1.5 CLEs provided by NYPWA)

This will be a presentation on what the law permits the local district to say to the media, as well as what the media may obtain in the way of records and whether they can show up at court, listen to a CPS or APS proceeding, and report on what they heard. If time permits, the presentation will include a discussion of recent issues.

This presentation will cover the legal aspects of CPS and APS caseworker liability, including both federal and state claims, and municipal liability based upon caseworker actions. If time permits, the presentation will also include a discussion of recent confidentiality issues.

Agenda

  • Please arrive to sessions early for CLE check-in.
  • Please review and choose which documents to download to your laptop or tablet or print out and bring to the conference.
  • Attorneys must attend in person to participate and to qualify for CLEs. Both attorneys and non-attorneys must bring handouts for legal sessions if they wish to have them at the conference.
  • All sessions are suitable for transitional and non-transitional attorneys.

 

The NYPWA Financial Assistance Policy CLE


The NYPWA Financial Assistance Policy for Continuing Legal Education In order to receive CLE financial assistance for a specific course, you must apply in writing, at least three weeks before the date of that course. CLE financial assistance is available for up to 50% of selected course fees for all attorneys based upon income guidelines for full time employment as set forth below.

Attorney Discounts:
Income under $25,000 – 50% discount
Income $25,000-$45,000 – 25% discount
Income above $45,000 – no discount

Application Process and Income Verification: Please forward a letter or an e-mail explaining the reasons for your request for financial aid. Applicants must state their total current yearly income from all sources of employment. Financial aid does not cover travel, hotel rooms, or meals.
